July 3, 2024 The Government of Kyrgyzstan adopted Resolution No. 349 amending Resolution No. 79 of the Government of the Kyrgyz Republic dated February 13, 2020 "On certain issues in the field of customs affairs". The resolution came into force after fifteen days from the date of official publication (published in the official state newspaper "Erkin-Too" dated July 9, 2024 No. 51), the Association of International Automobile Carriers reports.
The new regulation introduces customs duties for customs operations related to the release of goods in accordance with the customs transit procedure.
Customs duties are set at 0.4% of the customs value of the goods, while the minimum amount is 5 calculated indicators, and the maximum is 2500 calculated indicators. For making a preliminary decision on the classification of goods and on the origin of goods, customs duties in the amount of ten calculated indicators are charged. 1 the estimated figure is 100 soms or about 1.2 US dollars.
These fees are not charged in the following cases:
- transportation of goods from the customs authority at the place of arrival to the internal customs authority in the Kyrgyz Republic with the completion of the customs procedure of customs transit for further placement under other customs procedures;
- transportation of goods from one internal customs authority to another internal customs authority with the completion of the customs procedure of customs transit for further placement under other customs procedures;
- transportation of goods under the customs procedure of customs transit, previously placed under other customs procedures from the internal customs authority to the place of departure from the territory of the Eurasian Economic Union, except in the case of completion of the customs procedure of the customs warehouse by the customs procedure of customs transit to the territory of the member States of the Union.
Thus, all Customs transit shipments of goods through Kyrgyzstan and customs transit shipments starting after the customs warehouse procedure are subject to these new fees.
Customs fees must be paid before the completion of the customs procedure in Kyrgyzstan, i.e. before the goods in transit leave Kyrgyzstan.
The transport operators reported that the customs authorities have started to collect these fees.
The IRU, together with AIRTO KR, initiated consultations with the Government of Kyrgyzstan on the exemption of TIR operations from these charges in accordance with the TIR Convention of 1975.
